Существуют два основных типа судебного запрета: временный запретительный приказ [restraining order, preliminary injunction, interlocutory injunction] до проведения слушаний по делу [ hearing] в суде и бессрочный запрет [permanent injunction, final injunction], налагаемый после проведения слушаний. В историю страны судебные запреты вошли как превентивное средство пресечения забастовок, став основным средством борьбы с забастовками и бойкотами по антитрестовским законам Шермана [ Sherman Antitrust Act] (1890) и Клейтона [ Clayton Act of 1914]. Профсоюзы были ограждены от частого их применения Законом об ограничении судебных запретов [Anti-Injunction Act] (1932), но закон Тафта-Хартли [ Taft-Hartley Act] (1947) частично восстановил полномочия судов в этой области -
